Eligibility Criteria for EB-5 Visa

TQualified and well-established aspiring immigrants who want to be citizens of United States of America and take up permanent residence (green card) and who are willing to invest in various business opportunities in Unites States are eligible for EB-5 visa. The investor, spouse and minor children under age of 21 are also eligible for getting green card under the EB-5 visa program.

Eligibility Criteria for EB-5 visa:

1. Financial Investment:

   The investor should have sufficient legal financial reserves or resources to invest $1 million in US business. The investor should also show ability to invest smaller amount of $500,000 when investment is to be done in USCIS designated regional centers. 2. Form I-526:

   The Form I-526 petition is formally called as "Immigrant Petition by Alien Entrepreneur" and plays an important role in EB-5 visa process. The investor through this application that is filed before USCIS must show that the business investment process has been started in U.S. Other things that needs to be submitted along with this Form I-526 includes tax returns, funds transfer records, bank statements, thorough business plan, and article of incorporation.

3. Purchase of a U.S. Business:

   The investor can launch an entirely new company, restructure or reorganize an existing business, or can purchase and expand the present business operations.

4. Employment for U.S. nationals:

   The investment should lead to creation of ten new permanent full-time jobs for U.S. nationals. They all must be employed in the same business venture within two years of the investment. These jobs created must employ people outside the immediate family members i.e. it should not include the investor, spouse, or children.
